Military members have certain special privileges in divorce cases many of which come from the Service Member Civil Relief Act (amended 2003). For example military personnel are able to delegate their timesharing while deployed, likewise military personnel can stay divorce proceedings while deployed. Additionally there are special rules pertaining to the distribution of military pensions that do not apply to civilians. Sadly many practitioners make frequent mistakes with military personnel such as using the wrong coverage refracture when dividing a military pension, not selecting the appropriate SBP (survivor benefit plan) and/or failing to understand the insurance benefits of a service member.
